Collas Crill IP registered various trademarks for Syncro Health in both Guernsey and the EU, while GTC incorporated the company and will provide ongoing administration and other services.

    Acting for an employee in a successful claim against her former employer, Luxicabs, for unfair dismissal in the Employment Tribunal; enforcing that award and then successfully defending an appeal to the Royal Court brought by Luxicabs against that award/judgment, the Court, in the process, clarifying/confirming that awards of the Employment Tribunal are enforceable through the Jersey Courts.

    Acting for Defendants in proceedings brought by their former employer, Prince Jefri Bolkiah of Brunei.   The proceedings in the Royal Court of Guernsey concerned the obtaining of evidence for use in substantive proceedings in the District Court of the State of New York. Witnesses from Lloyds TSB were cross-examined in Guernsey by US counsel in Washington DC and New York via videolink, and Livenote facilities.

    Represented Sebastian Anflous in a case against J W Martel & Son Limited. Mr Anflous alleged unfair dismissal in relation to health and safety concerns or alternatively, constructive dismissal for the same health and safety concerns. Mr Anflous was working in an environment that contained corrugated sheeting believed to be made of/contain asbestos, but was advised by Mr Martel that he did not need any protective equipment and that the dust was not dangerous. Mr Anfluos was not convinced by Mr Martel's argument and left the site fearing for his health.  The firm successfully claimed unfair constructive dismissal for Mr Anflous after he refused to return to the site claiming health fears.

  • Moore (as administrator of the estate of Bjornson) v Mischca Limited

    Acted for the administrator of the estate of Maria Bjornson, a world-renowned theatrical/set designer whose credits include Phantom of the Opera. The nature of the dispute was a contractual claim in the approximate amount of £20 million for unpaid wages against a company owned by the Guernsey structure that was originally established to receive Ms Bjornson's income/royalties.

    Advice in relation to general employment matters for Flybe Limited - contentious and non-contentious. In particular,  the firm acted for Flybe on the Royal Court appeal of an unfair dismissal and sex discrimination claim brought before the Guernsey Employment Tribunal by a female pilot. The claim was the first sex discrimination claim to be heard by the Guernsey Employment Tribunal and, accordingly, the first sex discrimination appeal to be heard by the Royal Court.

  • Jane Stephens -v- States of Guernsey Department of Education

    Represented Jane Stephens in proceedings relating to her dismissal as the head teacher of the new Le Rondin School. Judicial review proceedings were commenced in the Royal Court. They were dealt with by Lt Bailiff Southwell QC (of Serle Court). A claim for unfair dismissal was brought successfully before the Employment Appeals Tribunal. Ancillary proceedings before the Royal Court of Guernsey for stigma damages etc were threatened but not commenced. The case was settled. This was a very high-profile matter reported widely in the local press. The proceedings became very political and resulted in a call for the resignation of the Minister of Education and Director of the Education Department, and an independent internal review of the Education Department.

  • Starboard Settlement / Herm Island

    Acted for the trustees of the Starboard Settlement in the acquisition of Herm Island. The transaction involved the negotiation and drafting of a new lease from the States of Guernsey of the 80 acre island and the acquisition from the previous owners of the businesses carried on there which include the White House Hotel and the Mermaid Tavern. A team drawn from across the firm worked on the transaction. Extensive negotiation and consultation was required with government and with Guernsey's constitutional representatives in the course of the transaction, making this a unique and highly sensitive transaction. Herm is highly regarded, in particular by the people of Guernsey: the change of ownership attracted significant attention in Guernsey and abroad.

  • Stuart Gunn -v- C L World Brands

    Represented Mr Gunn in a dispute with his former employer, one of the World's largest spirit producers and distributors based in the Caribbean, France and Scotland, that has a strong portfolio of Scotch whisky, rum and cognac brands, including Angostura. Mr Gunn was the company's Commercial Director. Following termination of Mr Gunn's employment, Mr Gunn issued statutory unfair dismissal proceedings against the Defendant and is also pursued a contractual claim seeking significant damages for an unpaid termination payment, unpaid bonuses, lost pension rights etc (totalling over £1 million). The matter was settled for a substantial sum.

  • Birch Insurance Brokers v Thomas Gibson

    Represented a UK based IFA (and its professional indemnity insurers) in third party proceedings by a local firm of financial advisers facing a series of mis-selling complaints by trustees of Retirement Annuity Trust Schemes (roughly equivalent to SIPPs). A global settlement of the dispute was reached at mediation.
