Welcome to the July edition of Collas Crill's Employment Newsletter.
 
In this edition we look at Jersey's proposed amendments to the laws regarding the employment of children and the amended powers of Jersey's Employment Tribunal to award monetary sums. We also look at the proposed amendments to Guernsey's employments laws generally and finally, we discuss the importance of handling misconduct issues appropriately.

The need to review Guernsey's Employment Law and protections: Results of the public consultation

In our February newsletter, we explained that Guernsey's Commerce & Employment Department had issued a consultation paper inviting the public to give its views on the state of Guernsey's current employment laws. That consultation process is now closed and the results are in...

The majority of the responses received overwhelmingly supported the view that Guernsey's current employment laws are inadequate. In particular, the public felt that Guernsey needs to implement more employment law, giving greater protection to those vulnerable and/or at risk as a matter of top priority. For example: the laws against discrimination need to be widened to protect persons from age/race and disability discrimination and there needs to be a statutory right to redundancy, maternity and holiday pay.

The Department has taken the public's view on board and has expressly stated that work on these employment protection priorities will be included in its business plan for 2012. Jersey has already made substantial progress in respect of some of these areas and it's about time that Guernsey followed suit. So, let's see what the next year brings!

 
 
Employment Tribunal Awards - new powers for the Jersey Employment Tribunal

On 17 June 2011 the Employment Awards Amendment (Jersey) Order 2011 came into force. This amendment equips the Jersey Employment Tribunal with additional powers to award monetary sums to a successful applicant. In this article Simon Hurry explores these powers.

 
 
The ABC of employing children

On 1 October this year the Children (Regulation of Employment) (Jersey) Order 2011 comes into force and provides the rules that will govern the way in which children (under the age of 16) are employed. In this article we look at the A B C of the Regulations - exercise books at the ready; there will be a short test at the end and in comic book tradition the answers are printed on the bottom of the page.

 
 
Employers: are you acting within the 'band of reasonable responses'?

In a recent decision Guernsey's Employment and Discrimination Tribunal dismissed an applicant's claim for unfair dismissal and held that the respondent employer had acted reasonably in treating the applicant's misconduct as a sufficient reason for his dismissal. Emma Parr explains the decision in this article but issues a word of warning to employers: always be mindful to adopt fair disciplinary procedures.
