A statutory image right regime and associated register and
legislative regime in Guernsey has been given the go-ahead after
debate in the States of Guernsey today.
Guernsey will be the first jurisdiction to have a registrable
image right and is therefore ideally placed to structure image
rights on behalf of sports and media celebrities.
The legislation is expected to be passed in early 2012, at which
point Guernsey will be ideally placed as the key global
centre for image rights registration and management.
With the legislation imminent, now is the time to review how the
legislation is likely to benefit clients who want to
control the way their own image is used and to begin planning
for the opportunities that will arise.
This legislation will allow celebrities, sporting personalities
and teams and other media personalities to structure their
image rights in Guernsey, safe in the knowledge that there is a
clear legislative framework.
