Overview

Kellyann is a Partner in the award-winning Private Client and Trusts team and is based in Jersey. She has over 15 years' experience in private client work and is both a Jersey advocate and a solicitor of the Supreme Court of England and Wales.

Experience

Kellyann acts for a range of professional trustees (local and international trust companies and bank owned trust companies), settlors, beneficiaries and ultra high net worth individuals. She advises on all aspects of Jersey law concerning wills, succession, foundations and trusts.

Kellyann's work often involves assisting the Jersey dispute resolution team (in both non-contentious and contentious court applications, including variation, rectification and mistake applications), corporate and property teams, as well as the UK real estate team.

She has contributed to leading legal texts, including the Jersey chapter in the 'International Comparative Legal Guide to: Private Client 2019', the Jersey chapter in Butterworths LexisNexis 'Encyclopedia of Forms and Precedents', the Oxford University Press publication entitled 'The World Survey' and has worked together with Jersey Finance to produce the Back to Basics Campaign on Jersey trusts and was interviewed by STEP on Philanthropy.

Kellyann is also a member of the Jersey Trusts Working Party, which is instrumental in developing the Jersey trust law.

Prior to 21 November 2014, Jersey looked to the case law of England and Wales for guidance in determining whether or not a particular purpose was a 'charitable purpose'. 

However, on that date, certain parts of the Charities (Jersey) Law 2014 came into effect, namely, the introduction of a statutory test for what is charitable (the charity test), the post of a Charity Commissioner and the establishment of a charity tribunal. 

The intent behind the law is to give confidence in Jersey as a centre for the good governance of public charities and for charitable and philanthropic activity generally.
