Collas Crill advises bank during criminal fraud proceedings

In the criminal case of Nicola Gavey who was convicted of fraud in the Royal Court of Guernsey on 8 April 2015, the bank took steps to recover the proceeds of the fraud from Mrs Gavey.

Collas Crill advised the bank during the Criminal proceedings against Mrs Gavey, as a result of which the law officers were persuaded to use the powers of The Criminal Justice (Proceeds of Crime) (Bailiwick of Guernsey) Law, 1999 to obtain a confiscation order against Mrs Gavey for the value of the stolen funds. The funds are to be returned to the bank once they are paid under the confiscation order.

The confiscation order offered a much more powerful and cost effective means of recovering the funds on behalf of the bank than alternative civil remedies.
