What has the trusts team been doing so far this year…?
It's been a very busy and exciting start to 2018 for our trusts team. Some of the highlights include:
Appearing before the Court of Appeal in the Crociani matter that has been extensively reported worldwide.
Representing HMRC before the Royal Court (see case review below).
Advising the trustees of a charitable trust owning intellectual property rights in connection with a proposed restructuring of the £300 million structure.
Assisting with the establishment of a Jersey trust for Emirates Global Aluminium PJSC to safeguard the interests of 8,000 employees across the UAE region. With the lack of any pension provision in the UAE, we have seen a noticeable increase in clients wishing to explore ways of enabling their employees to plan for the future.
Advising an ultra high net worth in divorce and ancillary proceedings, involving a host of issues, including whether several Jersey trusts (which collectively own the majority of the ultra high net worth's wealth) are susceptible to variation as a post-nuptial settlement and/or whether the assets of the trust should be brought into the reckoning as matrimonial resources and therefore divisible on divorce.
